What You Say During Counseling Is Protected by Law
In essence, there are laws in place that protect the patient during their therapy sessions, which state that anything had spoken during the session stays between the therapist and the patient. It cannot be repeated nor can it be used against them in a court of law.
The Law Does Apply to Individuals Under the Age of 18
Patients who have not yet attained the legal age of adulthood are also protected by the HIPPA privacy laws. This means that anything you say to your therapist in confidence during a session cannot be repeated, not even to your parents or school officials.
Exceptions to the Dr. or Patient Confidentiality
However, there are exceptions to the HIPPA privacy policy, which are as follows:
If a client intends to harm himself or herself, we will make every effort to enlist their cooperation in ensuring their safety. If they do not cooperate, further measures must be taken without their permission that are provided to us by law in order to ensure their safety
If a client is threatening serious bodily harm to another person/s, we must notify the police and inform the intended victim
Suspected abuse - child, dependent adult or elder - we are required by law to report this to the appropriate authorities immediately
